If you want to change or cancel any aspect of your booking including but not limited to a change to a trip of shorter duration or different departure date you must notify us in writing over a mail. We will do our best to accommodate your requested change but it may not always be possible. We will not charge a fee for changes requested more than 45 days before departure except where we incur a cost, in which case we will advise you of the relevant fee.
The above structure applies for Backpacking tours as well.
Cancellation fees, if any, will be determined with reference to the date on which written notice of cancellation over a mail is received by Trekmunk and are expressed as a percentage of the total price paid for the cancelled tour/trek/trip, product or service (excluding any insurance products).
For certain products or services offered by Trekmunk, including bookings on or related to the Expedition; alternative cancellation terms may apply. Trekmunk will advise you of any such requirements prior to confirmation of the applicable booking. If not, the below-mentioned cancellation terms will be applied.
If you cancel your trip you will need to pay our applicable cancellation fee as follows:
If you cancel your trip before the departure date you may request in writing at the time of cancellation that we provide you with a voucher for use against a future trip. The value and currency of the rolling deposit will be the value and currency of the original deposit paid minus the convenience charges. The voucher cannot be redeemed by re-booking the same trip for the same departure date originally booked. The voucher must be redeemed within one year from the date of the first cancellation. The voucher cannot be transferred to anyone. The passenger must be between 18 to 65 years old to travel or accompanied by an adult in case the passenger is below 18 years of age. Only one voucher per person per trip is permitted. If redeeming against a trip with a higher deposit the balance will be payable at the time of booking. Vouchers cannot be redeemed or refunded for cash.
i) Cancellation up to 30 days before the start date of the trip and not counting the day of the trip: Full refund with 100% of the trip fee in the form of a Trekmunk Trip Voucher.
ii) Cancellation during 29 to 10 days before the start date of the trip, and not counting the day of the trip: 10% of the booking amount is forfeit and you are eligible to get a refund of 90% of the trip fee in the form of a Trekmunk Trek Voucher.
iii) Cancellation during 9 to 1 day before the start date of the trip, and not counting the day of the trip: 30% of the booking amount is forfeit and you are eligible to get a refund of 70% of the trek fee in the form of a Trekmunk Trek Voucher.
iv) Cancellation on the start day of the trip, or no show on the start day of the trip: 100 percent of the paid amount will be forfeit and you will not be entitled to any refunds in form of money or voucher.
i) Voucher will be valid for 1 year from the date of issue. Can be used on any Trekmunk tour.
ii) If you have used a voucher to book for the trek or offloading, the same cancellation percentage will be applicable and the remaining voucher will be credited back to your account, the validity of the new voucher will remain the same as the old voucher.
iii) The convenience fee/transaction charge is not refundable in all cases.
i) Cancellation up to 45 days before the start date of the tour and not counting the day of the tour: 10% of the booking amount is forfeit and you are eligible to get a refund of 90% of the total amount you have paid for the booking excluding insurance and convenience charges. The money will be refunded to the same bank account, credit, or debit card from where the payment was made.
ii) Cancellation during 44 to 30 days before the start date of the tour, and not counting the day of the tour: 20% of the booking amount is forfeit and you are eligible to get a refund of 80% of the total amount you have paid for the booking excluding insurance and convenience charges. The money will be refunded to the same bank account, credit, or debit card from where the payment was made.
iii) Cancellation during 29 to 15 days before the start date of the tour, and not counting the day of the tour: 30% of the booking amount is forfeit and you are eligible to get a refund of 70% of the total amount you have paid for the booking excluding insurance and convenience charges. The money will be refunded to the same bank account, credit, or debit card from where the payment was made.
iv) Cancellation during 14 to 1 day before the start date of the tour, and not counting the day of the tour: 50% of the booking amount is forfeit and you are eligible to get a refund of 50% of the total amount you have paid for the booking excluding insurance and convenience charges. The money will be refunded to the same bank account, credit, or debit card from where the payment was made.
v) Cancellation on the start day of the trek, or no show on the start day of the tour: 100 percent of the paid amount will be forfeit and you will not be entitled to any refunds in form of money or voucher.
The convenience fee/transaction charge is not refundable in all cases.
This is the policy we follow:
We almost never cancel our trips. But in case we cancel a trip because of natural calamities (snowstorms, thunderstorms, floods, landslides, earthquakes) or unexpected political unrest, curfews, local riots, lockdown, curfew, or government orders, Trekmunk will issue a voucher for the full amount of your trip fee (minus the trek insurance). You can redeem the Trip Voucher on any of our trips over the next one year. Trip insurance is not refundable.
a) Our tours/trips/treks are designed strictly for fit people between the ages of 10 to 65 years with certain exceptions in terms of age but not in fitness. We do not issue any kind of refund neither in cash nor in voucher to those who you come down/return from a trip/trek when your mountain guide/trip leader sends you down due to any of these reasons: lack of fitness, not able to maintain timing of daily tour/trek distance or if you're found drinking/smoking or breaking protocols of the trip or if you quit the trip/trek on your own will due to personal reasons.
Note: This policy only applies for trekking tours under 5000 metre altitude in India and is not applicable on Expeditions and backpacking tours.
You can do the same trek with us again within a year without paying trek fee again for either of the following reasons i) or ii) mentioned in this section after Trekmunk validates the reason and approves the request. The next dates will depend on availability and you have to inform us at least 45 days in advance before the adventure start date and Trekmunk shall provide you with an available date or a list of available dates which you can book under this policy.
i) If your entire group is forced to abandon the trip/trek after you have reached the basecamp of any trip/trek, this could be due to weather and or any sudden unforeseen circumstances.
ii) In case of health issues that may arise during the adventure due to the nature of activity of the adventure e.g. Altitude sickness, injury during trek which are not due to a pre-existing medical condition and or lack of fitness or negligence of following the trip protocols.
By booking a Tour/Adventure Trip/Trek with Trekmunk, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you make a booking on behalf of other participants, you guarantee that you have the authority to accept and do accept these Terms on behalf of the other participants in your party.
Please read all the booking conditions carefully. You must not make any booking with Trekmunk Private Limited unless you understand and agree with these Trekmunk Private Limited booking conditions and any additional terms applicable as indicated above and/or at the time of booking.
The forest charges, camping fees, permits, wildlife fee or any other fee can increase or decrease or new fees can come up which were not included in your package at the time of the booking, you are liable to pay those fees unless mentioned in your package at the time of booking. Trekmunk will inform you of such fees or permits before the departure date of the trip/trek/tour if any.
Bookings can be made through our online portal/website by paying the complete amount in advance via a secure payment portal. A contract between you and us (Trekmunk Private Limited) will exist as soon as we issue an invoice in response to your request for a booking.
a) You can postpone your booked trek for a period of two months (61 days) but Trekmunk will charge a 20% processing fee. The last date for the postponement will be 15 days before the start of the trek. You can book any slot for the same trek in the next 2 months (61 days) which will totally depend on the availability. You will have to confirm your slot for your future trek 15 days prior to that trek. Failing to book the slot in 2 months (61 days) time, would be considered a cancellation with no refund of any kind. The 2 months (61 days) time frame will be from the start date of the initial trek you booked for. Postponing a booked trek can only be done once. If it is postponed 45 days before the departure date, we will not charge any fee.
b) If you are prevented from travelling as a result of illness, death of an immediate family member, jury service or other reason beyond your control which we consider significant, we may agree to your booking being transferred to another person who satisfies all the conditions applicable to the trip/trek, subject to you and the other person accepting liability for full payment of the trip cost and any additional costs arising from the transfer and provided that you give us not less than 15 days' written notice of the proposed transfer.
Departure date for a tour/trip/trek offered by the Trekmunk will become a guaranteed departure when at least five bookings secured by a valid deposit have been made on that departure.
Trekmunk guarantees that all scheduled tour/trek/trip departures booked and secured with a valid deposit will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms or good faith health and safety concerns. This guarantee is not applicable in the case of Force Majeure. Up to date Tour and itinerary information is available on the Trekmunk's website or by contacting the Trekmunk. Brochures and other printed materials displaying tour/trip/trek information and departure dates are subject to change may not be relied upon for purposes of this guarantee.
If a tour/trip/trek is cancelled by the Trekmunk for reasons other than Force Majeure and the cancellation is not caused by your fault or negligence, you will have the choice of accepting from Trekmunk:
(a) a substitute tour/trek/trip of equivalent or superior value; or
(b) a substitute tour/trip/trek of lesser value if no tour/trip/trek of equivalent or superior value is reasonably available and to recover the difference in price between the price of the tour/trip/trek originally purchased and the substitute tour/trip/trek in form of money or a trek voucher.
(c) a full refund of all monies paid for the cancelled tour/trip/trek. (Excluding deposit, insurance and convenience/transaction charges)
(d) a trek voucher for the paid amount to be used for future trips/treks/tours within a year.
Trekmunk is not responsible for any incidental expenses or consequential losses that you incur as a result of the cancelled booking including visas, vaccinations, non-refundable flights or rail, non-refundable car parking or other fees, loss of earnings, or loss of enjoyment, Trekmunk reserves the right to issue a full refund in lieu of the choices above, in its sole discretion. Where a significant element of a Tour/trip/trek as described cannot be provided after departure, the Trekmunk will make suitable alternative arrangements where possible. If it is not possible to provide a suitable alternative or if you reasonably reject any suitable alternatives, Trekmunk may provide you with a refund for unused products or services as determined in its discretion.
Changes made by Trekmunk: Trekmunk may modify your itinerary where reasonably required in its sole discretion. If Trekmunk makes a change affecting at least one in four full days of the itinerary or which materially affects the character of a product or service in its entirety (a "Material Change"), Trekmunk will provide notice to you as soon as reasonably possible, provided that there is sufficient time to do so before departure. If a Material Change is made more than 30 days before departure, you may choose to:
i) accept the Material Change and proceed with the amended trip/trek/tour or product or service;
ii) book another trip/trek/tour or product or service of equal or greater value, if available (you will be responsible for paying any difference in price); or
iii) book another trip/trek/tour or product or service of lesser value, if available (with a refund payable to you for the difference in price); or
iv) cancel the amended trek/trip/tour or product or service and receive a full refund (excluding deposit, insurance and convenience/transaction fee) of the applicable product or service (a refund is not available for other products or services booked which are not subject to a Material Change).
You must notify the Trekmunk of your choice within 7 days of receiving notice or you will be deemed to accept the amended itinerary.
Once a Tour has departed, itinerary changes may be necessary as a result of unforeseen circumstances, operational concerns, or concerns for your health, safety, enjoyment or comfort. Any changes are at the discretion of Trekmunk and its representative. You acknowledge that you must have reasonable financial resources to cover incidental expenses during all travel with Trekmunk, whether or not such expenses arise from a change of itinerary, and Trekmunk is not liable for your failure to prepare adequately for travel and unforeseen circumstances which may arise during travel. Trekmunk will not be liable for any indirect and or consequential losses associated with any changes to a booking or itinerary.
Changes made by you: You are responsible for ensuring that information provided to Trekmunk is accurate and up-to-date. Any changes to your name on any booking are subject to the Trekmunk's approval. Any changes to a booking depend on availability and are subject to the Trekmunk's approval and these terms. Any extra costs incurred for making the change will be charged to you along with an administrative fee. Cancellation of any tour/trek/trip, product or service included in a booking will not be considered a change for purposes of this section and will be governed by the applicable cancellation terms. No changes are permitted to any booking within 10 days of departure of the first product or service on the applicable booking.
By booking on behalf of other participants, you are deemed to be the designated contact person for every participant included in that booking. This means that you are responsible for making all payments and formalities due in connection with your trip/trek/tour booking.
By booking on behalf of another person or persons, you represent and warrant that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate and we will under no circumstances be liable for any errors or omissions in the information provided to complete a booking.
In case you are booking for a child (age<18), then the person booking the trek or any adult from the family of the child will be considered as the Guardian and will have to accompany the child on the trip/trek/tour. The Guardian will have to take full responsibility of the child and will have to sign the waiver form on behalf of the child.
REQUIRED MEDICAL INFORMATION
You must provide any medical information reasonably requested by Trekmunk and may be required to complete the medical information form which will be mailed to you after you have booked the trip/trek/tour. This Medical form(either offline or online) is mandatory and has to be signed by a doctor.
Medical Forms are mandatory for certain Tours. If you have any pre-existing medical conditions which may impact your ability to travel, participate in a tour/trek, travel to remote areas without access to medical facilities or may adversely affect the experience of others on your tour/trek, you must return a Medical Form, signed by a licensed and practising physician to the Tour Operator prior to or at the time of final payment for the applicable booking.
You agree to complete the Medical Form honestly and to disclose all relevant medical information accurately and fully and agree to sign the Waiver form provided by Trekmunk before going for the trip. Trekmunk reserves the right to request further information or professional medical opinions where necessary, as determined in its discretion, for your safety or the safe operation of a tour/trek/trip.
Trekmunk reserves the right to deny you permission to travel or participate in any aspect of a tour/trek/trip at any time and at your own risk and expense where our representative determines that your physical or mental condition renders you unfit for travel or you represent a danger to yourself or others.
Pregnancy is considered a medical condition and must be disclosed to us at the time of booking. Trekmunk may refuse to carry women who are over 24 weeks pregnant. Trekmunk may refuse to carry anyone with certain medical conditions if reasonable accommodation or alternatives cannot be arranged.
In the event that you do not complete the required Medical Form or provide medical information reasonably required by Trekmunk for any reason by the deadline indicated above, Trekmunk reserves the right to cancel your booking and all applicable cancellation fees will apply according to our cancellation policy above.
You are responsible for assessing whether a tour/trip/trek is suitable for you. You should consult your physician to confirm your fitness for travel and participation in any planned activities. You should seek your physician's advice on vaccinations and medical precautions. Trekmunk does not provide medical advice. It is your responsibility to assess the risks and requirements of each aspect of the tour/trek/trip based on your own unique circumstances, limitations, fitness level, and medical requirements.
Travel with Trekmunk may involve visiting remote or developing regions, where medical care may not be easily accessible and medical facilities may not meet the standards of those found in your home country. The condition of medical facilities in the countries/areas you may visit on your tour/trek/trip varies and Trekmunk as well as its tour operators make no representations and give no warranties in relation to the availability or standard of medical facilities in those regions.
Anyone under the age of 18 on the date of first travel is considered to be a minor. Minors must always be accompanied by an adult. One adult may accompany up to two minors. Unless otherwise indicated in the tour/trip/trek description or by the Tour Operator or Trekmunk, the minimum age for minors travelling on any tour is 10 years old.
All bookings with a minor are subject to review and approval by Trekmunk. If the consent of a parent, guardian or any other person is required by applicable law for any minor to travel, the accompanying adult is responsible for securing all consents, documentation and ensuring that they and the minor(s) meet all legal requirements to travel, to enter into and depart from applicable countries and regions. Trekmunk or its tour operators will not be responsible for any fees, damages, or losses incurred as a result of any failure to secure necessary consents, permits, and approvals.
Each adult on a booking with a minor or minor(s) is jointly and severally responsible for the behaviour, wellbeing, supervision and monitoring of such minor(s), and jointly and severally accepts these Terms for and on behalf of any minor(s) on their booking, including all assumptions of risk and limitations of liability. Trekmunk or its tour operators do not provide care services for minors and expressly disclaims any responsibility for chaperoning or controlling any minor(s).
Please ensure you carefully read your invoice, package details and all other documents Trekmunk sends to you as soon as you receive them and contact us immediately if you have any doubts about it. If any information appears to be incorrect. Trekmunk will not accept any liability if you fail to notify us of any inaccuracy in any document within 14 days of us sending them to you. You are responsible for ensuring that you have the correct and valid travel documents including passports, visas and vaccination certificates. We strongly recommend that you verify the current documentation requirements with your travel agent. Please note requirements change and you must check with your consulate for the most up to date information, including but not limited to visa requirements for the countries visited on your trip. Passports must have an expiry date of at least six months after completion of the trip. We will take care of all the permits, camping fees, forest charges and other charges for the booked trek/trip/tour, you are liable to pay for them if these charges are not included in the package inclusions while booking the trek/trip/tour.
You must clearly state all your dietary requirements at the time of booking. Trekmunk cannot guarantee that special dietary requirements can be met and we cannot take responsibility for any such requirements not being fulfilled. You will be charged extra for meeting the dietary requirements.
If you have a medical condition or require special arrangements that may affect your trip/trek/tour, Trekmunk asks that you inform us in writing at the time of booking. If Trekmunk cannot reasonably accommodate your particular needs we may decline the booking or ask for you to be accompanied by a person who is able to provide full assistance to you throughout your trip. You will be charged extra for this.
You will not be permitted to embark or continue on the trip if in the reasonable opinion of our representative: your mental or physical condition renders you incapable of caring for yourself, you become objectionable to other passengers or you become a hazard to yourself or other passengers or any other emergency situations related to your health. Immediate termination of your trip/trek/tour may occur should you possess or transport illegal or restricted substances (drugs) or where you have engaged in any illegal activity during a trip/trek/tour. Trekmunk will not be responsible for expenses resulting in you being precluded from completing the trip/trek/tour for any reason, nor will Trekmunk refund you any part of your trip cost. In all cases, Trekmunk will notify you of the reasons why we have taken this action. We will have no obligation to arrange for your return to the point of the trip/trek/tour departure if your condition manifests itself after the trip/trek/tour departure.
You agree to indemnify us in full against all losses (direct and indirect and howsoever caused) arising from any third-party actions taken against us for loss or damage caused by you or arising from your participation on the trip/trek/tour.
Trekmunk and its subsidiaries and their respective employees, affiliates, officers, directors, successors, representatives, and assigns shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. You waive any claim against Trekmunk for any such loss, damage, injury, or death.
You must take out comprehensive travel insurance before you travel on your trip/trek/tour. Your insurance protection must include cover for cancellation, medical and repatriation expenses, personal injury and accident, death, and loss of personal baggage and money and personal liability insurance. Evidence of such insurances must be produced to Trekmunk on request and normally on day one of your trip or before that. The insurance cover offered by credit card companies or reciprocal medical cover agreements is often not comprehensive.
Trekmunk will provide domestic insurance options for Indians only, which will be mandatory on the selected trips/treks/tours. The insurer organisation is a third party organisation, you can directly contact your insurer for any claims, Trekmunk will not be a part of the claim procedure unless requested.
If you make a claim against Trekmunk you agree to assign to us or our insurers any rights to take action against any third party supplier/tour operator or any other person or party that may have been wholly or partly responsible for the claim or who Trekmunk reasonably considers should be a party to the action. You must cooperate fully with Trekmunk, should Trekmunk or its insurers wish to enforce those rights which have been assigned to Trekmunk. If you make a claim against us which is covered by your insurance policy, you agree to pursue the claim through your insurer either in addition to or in substitution for, your claim against us (if any). We agree to indemnify you in respect of reasonable expenses incurred in successfully pursuing such a claim and acknowledge that any settlement made by the insurer shall not prejudice your rights against us.
In the event of any dissatisfaction with any service provided by Trekmunk, you must report it immediately to the Trip Leader so that action can be taken to remedy the problem. Failure to immediately notify the Trip Leader of any problem may result in your claim for compensation (if any) from us being denied or reduced. Any complaint made to Trekmunk following the conclusion of the trip should be made in writing/mail within 28 days of completion of the trip. In the event that you do not notify us in writing within 28 days, Trekmunk's ability to investigate the complaint may be prejudiced.
Trekmunk is committed to protecting your personal information and agrees to process your personal information in accordance with our Privacy Notice, which is available online on our website. In order to make your booking and ensure that your travel arrangements run smoothly, Trekmunk needs to use the information you provide and pass it on to other relevant suppliers and our team members who are responsible for parts of your travel arrangements. In many cases, this will include transferring your data to overseas recipients (including to recipients outside of India).
All dates, itineraries, and prices of tours/treks/trips are subject to change at any time and the current price will be quoted and confirmed at the time of booking, subject to any surcharges that may be levied in accordance with these Terms.
You acknowledge that you are responsible for keeping up to date on the specific details of your tour/trek/trip and any other products or services, including, but not limited to checking the Trekmunk's website at least 72 hours prior to departure as minor changes may have been made after the time of booking.
As a condition of booking, you must provide the information requested by Trekmunk along with the final payment. If you fail to supply information required by Trekmunk for tickets, permits, or other inclusions, you will also be liable for any costs, fees or losses including failure to obtain or provide that inclusion. In the event that you fail to supply information required by Trekmunk, Trekmunk also reserves the right to treat your booking (or the relevant component of your booking) as cancelled and levy any cancellation fees deemed reasonable by the Trekmunk, in its sole discretion. The information required by Trekmunk will vary by tour/trip/trek and will be communicated to you or to the Trekmunk's representative during the booking process or before the tour/trip/trek starts. Trekmunk and its tour operators will not be held responsible for any fees you incur as a result of errors, omissions, inaccuracies, late, misplaced or otherwise incomplete information you have provided.
You acknowledge that the nature of adventure travel requires flexibility and acknowledges that you will permit reasonable alterations to products, services or itineraries by Trekmunk. The route, schedules, accommodations, activities, amenities, and mode of transportation are subject to change without notice due to unforeseeable circumstances or events outside the control of Trekmunk and its tour operator (including but not limited to Force Majeure, illness, mechanical breakdown, flight cancellations, strikes, political events and entry or border difficulties). No reimbursements, discounts or refunds will be issued for services that are missed or unused after departure due to no fault of Trekmunk and its tour operators, including your removal from a tour/trip/trek because of your negligence or breach of these Terms.
You acknowledge that adventure travel and the products and services offered by Trekmunk may involve a significant amount of risk to your health and safety. By travelling with Trekmunk, you acknowledge that you have considered any potential risks to health and safety. You hereby assume responsibility for all such risks and release Trekmunk from all claims and causes of action arising from any losses, damages or injuries or death resulting from risks inherent in travel, including adventure travel specifically, visiting foreign destinations, and participating in adventurous activities such as those included in Tour itineraries or otherwise offered by Trekmunk. Trekmunk requires that you confirm your assumption of this responsibility by completing the participation waiver (the "Waiver") prior to departing on your tour/trip/trek. The Waiver is available on our website: https://www.trekmunk.com/disclaimers
You acknowledge that the degree and nature of personal risk involved depends on the products or services booked and the location(s) in which a product or service operates and that there may be a significant degree of personal risk involved in participating, particularly participating in physical activities, travel to remote locations, carriage by watercraft, participation in "extreme sports" or other high-risk activities, or travel to countries with developing infrastructure. Standards of hygiene, accommodation, and transport in certain countries where tours/trips/treks take place are often lower than the standards you may reasonably expect in your home country or region. You agree that Trekmunk is not responsible for providing information or guidance with respect to local customs, weather conditions, specific safety concerns, physical challenges or laws in effect in any locations where a tour/trip/trek, product or service is operated. You acknowledge you have considered the potential risks, dangers and challenges and your own personal capabilities and needs, and you expressly assume the risks associated with travel under such conditions.
You must at all times strictly comply with all applicable laws and regulations of all countries and regions. Should you fail to comply with the above or commit any illegal act when on tour/trek/trip or, if in the opinion of the Trekmunk representative (acting reasonably), your behaviour is causing or is likely to cause danger, distress or material annoyance to others, Trekmunk or its representative may terminate your travel arrangements on any product or service immediately at your expense and without any liability on Trekmunk's part. You will not be entitled to any refund for unused or missed services or costs incurred as a result of the termination of your travel arrangements, including, without limitation, return travel, accommodations, meals, and incidentals.
You are responsible for any costs (including repair, replacement and cleaning fees) incurred by Trekmunk or the Trekmunk's suppliers for property damage, destruction or theft caused by you while on a tour/trip/trek. You agree to immediately report any pre-existing damage to a representative of Trekmunk and staff of the accommodation, transportation service, or facility as soon as possible upon discovery.
You agree to take all prudent measures in relation to your own safety while on tour/trip/trek including, but not limited to, the proper use of safety devices (including seatbelts, harnesses, flotation devices, and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. Neither Trekmunk nor its Third Party Suppliers (as defined herein) are liable for loss or damages caused by your failure to comply with safety instructions or warnings.
Trekmunk makes arrangements with accommodation providers, activity providers, airlines, cruise lines, coach companies, transfer operators, shore excursion operators, tour and local guides, and other independent parties ("Third Party Suppliers") to provide you with some or all of the components of your booking. Third-Party Suppliers may also engage the services of local operators and sub-contractors. Although the Trekmunk takes all reasonable care in selecting Third Party Suppliers, Trekmunk is unable to control Third Party Suppliers, does not supervise Third Party Suppliers and therefore cannot be responsible for their acts or omissions. Any services provided by Third Party Suppliers are subject to the terms and conditions imposed by these Third Party Suppliers and their liability is limited by their tariffs, conditions of carriage, tickets, and vouchers and international conventions and agreements that govern the provision of their services. These may limit or exclude liability of the Third Party Supplier. You acknowledge that Third-Party Suppliers operate in compliance with the applicable laws of the countries in which they operate and Trekmunk does not warrant that any Third Party Supplier is in compliance with the laws of your country of residence or any other jurisdiction.
Trekmunk is not liable and will not assume responsibility for any claims, losses, damages, costs or expenses arising out of inconvenience, loss of enjoyment, upset, disappointment, distress or frustration, whether physical or mental, resulting from the act or omission of any party other than Trekmunk and its employees.
Trekmunk is not liable for the acts or omissions, whether negligent or otherwise, of Third Party Suppliers or any independent contractors.
"Optional Extras" refers to any activity, transportation, meal, product or service not expressly included in the Tour/trek/trip itinerary or price of the Tour/trek/tour and which does not form part of the Tour/trip/trek. You agree that any assistance was given by the Trekmunk's representative(s) in arranging, selecting, or booking, any Optional Extras is purely at your request and Trekmunk makes no warranties and expressly disclaims any liability whatsoever arising from participation in Optional Extras or any information provided by any representative of Trekmunk regarding any Optional Extras. You release the Trekmunk from all claims and causes of action arising from any damages, loss of enjoyment, inconvenience, or injuries related to or arising from participation in or booking of Optional Extras.
You acknowledge and agree that any liability for loss, damages, death, personal injury, illness, emotional distress, mental suffering or psychological injury or loss of or damage to property associated with Optional Extras is the sole responsibility of the third party providing that service or activity.
Trekmunk will not be liable in any way for death, bodily injury, illness, damage, delay or other loss or detriment to person or property, or financial costs both direct and indirect incurred, or for the Trekmunk's failure to commence, perform or complete any duty owed to you if such death, delay, bodily injury (including emotional distress or injury), illness, damage or other loss or detriment to person or property is caused by Act of God, war or warlike operations, mechanical breakdowns, terrorist activities or threat thereof, civil commotions, labor difficulties, interference by authorities, political disturbance, howsoever and where so ever any of the same may arise or be caused, riot, insurrection and government restraint, fire, extreme weather or any other cause whatsoever beyond the reasonable control of Trekmunk; or an event which Trekmunk or the Third Party Supplier of services, even with all due care, could not foresee any and all of which, individually and collectively, constitute "Force Majeure".
You agree that, while participating in any Tour, images, photos or videos may be taken by other participants, Trekmunk or its representatives may contain or feature you. You consent to any such pictures being taken and grants a perpetual, royalty-free, worldwide, irrevocable licence to Trekmunk, its contractors, sub-contractors and assigns, to reproduce for any purpose whatsoever (including marketing, promotions and the creation of promotional materials by or with sub-licensees), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation or compensation payable to you.
